Vinod @ Manoj Vs State of Haryana and Ors.

This petition has been moved by Vinod @ Manoj, under Section 482 of Cr.P.C. read with Section 3(1) (a) of the Haryana Good Conduct Prisoners ( Temporary Release) Act, 1988, seeking emergency parole for getting performed the heart surgery of his father.

As averred in the petition, the petitioner was arrested in a case F.I.R.No.03 dated 03.01.2004 for the offences punishable under sections 148/149/302/120-B IPC in Police Station Baroda and was convicted and sentenced by the learned Additional Session Judge, Sonepat on 25.09.2008.

I have heard the counsels for the parties, besides perusing the record with due care and circumspection.

This petition is disposed of with a direction to the respondents that the petitioner shall be released on parole in view of the provisions of Section 3(1)(a) of the Haryana Good Conduct Prisoners (Temporary Release) Act, 1988, for a period of two weeks from the date of his release,

subject to the satisfaction of District Magistrate, Rohtak, who shall take an adequate surety before releasing him under the rules. After expiry of the abovesaid parole period, the petitioner shall surrender before the Superintendent, District Jail, Sonepat-Respondent No.3.
