Satpal @ Sattu and Ors. Vs State of Haryana

Vide detailed order dated 8.5.2009, notice of motion was issued qua Bhoori @ Balbir (petitioner No.2) and Phundi @ Gian Chand (petitioner No.5) and their arrest has been stayed subject to their joining the investigation. Counsel for the petitioners submits that petitioners No.2 and 5, whose arrest was stayed by this Court, have already joined the investigation. This fact is admitted by learned counsel for the State on instructions received from ASI Narender Kumar. Counsel for the State further submits that main accused were Satpal @ Sattu (petitioner No.1), Udai Singh and Dharampal @ Pala (petitioner No.3), who have already been arrested.

In view of the above, order dated 8.5.2009 is hereby made absolute qua petitioners No.2 and 5. Petitioners No.2 and 5 shall keep on joining the investigation as and when called for. They shall also abide by the provisions of Section 438(2) Cr.P.C.

The petition is disposed of qua petitioners No.2 and 5.
