Counsel for the petitioner contends that in terms of the order passed by this Court dated 5.6.2009, the petitioner has joined the investigation. This fact is admitted by the State counsel, on instructions received from HC Yashpal Singh. Counsel for the State further submits that the petitioner is no more required for custodial interrogation.
In view of the above, order dated 5.6.2009 is hereby made absolute. The petitioner shall keep on joining the investigation as and when called for. He shall also abide by the provisions of Section 438(2) Cr.P.C.
The petition is disposed of.
