Heard Mr. Madhav Kumar, learned counsel for the

petitioner and Mr. B.N. Pandey, learned APP for the State.

The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 201 and 34 of the Indian Penal Code.

The case of the prosecution is that the petitioner along with other accused persons murdered the nephew of the informant by strangulating him and buried the body with the intent to conceal the crime.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned

counsel for the petitioner has submitted that from perusal of the FIR itself, it is clear that there is no eye witness of the occurrence. There is nothing except the confessional statement. It has also been submitted that similarly situated other coaccused person has been granted regular bail by learned coordinate Bench of this Court vide order dated 21.08.2023 passed in Cr. Misc. No. 27746 of 2023 and one other coaccused person as well has been granted anticipatory bail by learned co-ordinate Bench of this Court vide orded dated 09.04.2024 passed in Cr. Misc. No. 86614 of 2023. The case of this petitioner stands on similar footing. The nature of allegation against this petitioner is general and omnibus and no any specific overt act has made against him. Moreover, he is languishing in judicial custody since 09.04.2025.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bibhutipur P.S. Case No. 437 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like
