Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 224, 225, 307, 353, 272, 273, 506 of Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

The case of the prosecution is that the police had information that notorious criminal the petitioner was about to arrive. The police made endeavour to arrest him but it is alleged that the villagers got him released. It is further alleged that from a wagon R vehicle, altogether 750 ml of liquor was recovered. It is alleged that the named accused started pelting stones on the police personnel.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the only allegation against this petitioner is that he was being released by the villagers and that 750 ml of liquor was recovered from a wagon R vehicle. Learned counsel for the petitioner has submitted that petitioner is having criminal antecedent of seventeen cases. It has further been submitted that the petitioner has been framed in many cases after Vaishali (Belsar O.P.) P.S. Case No. 495 of 2021. It has further been submitted that there is no other material against the petitioner. Moreover, he is languishing in judicial custody since 18.12.2024.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
