The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 352, 351(2), 351(3) and 74 of the B.N.S. and later on Section 103(2) of B.N.S. was added.

The case of the prosecution is that petitioner along with others being armed with rod , lathi , gadhahel , dabiya arrived at the house of the informant. It is specifically stated that Shambhu Mandal assaulted with iron rod to the father of the informant due to which he fell down. After that, Anandi Mandal assaulted to Pankaj Mandal.

Learned counsel for the petitioner submits that the

petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that though the petitioner has been arrayed as an accused in this case but no specific overt act is alleged against him. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 28.03.2025.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Simraha P.S. Case No. 57 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria.
