Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in connection with Dariapur P.S. Case No. 487 of 2023 dated 02.08.2023 registered for the offences punishable under Section 306 of the Indian Penal Code.

As per the prosecution case, the informant’s daughter was studying in Patna but she had come to their village during school holidays. In the village, the informant’s daughter resided with her grandparents and other family members along with the petitioner. On 28.07.2023 at 7:00 A.M. the informant’s daughter committed suicide, having died by hanging. The informant was informed of her daughter’s death on the phone.

The informant came to her village from Patna and she found her daughter’s body lying on the ground. The informant believes that Raja Kumar(petitioner) compelled her daughter to commit suicide by hanging.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has sprung up in this on mere suspicion as the informant has strong faith that the petitioner has provoked her to hanging. The charge-sheet has been submitted against the petitioner. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.11.2023.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st class, Saran at Chapra in connection with Dariapur P.S. Case No. 487 of 2023, with the condition:-

(i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
