Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Araria (R.S.) P.S. Case No. 926 of 2022, registered for offence punishable under sections 341, 323, 186, 290, 291, 353, 406, 420/34 of the Indian Penal Code and Sections 3/4/11 of Bengal Public Gambling Act.

As per allegation, on secret information, the police personnel raided the gambling spot. The petitioner and coaccused Mantu Sahni surrounded the police personnel and scuffled with them. The petitioner abused the informant and told that they will not stop gambling, but seeing the backup police force, the petitioner and other co-accused persons fled away and

six pieces of Pasas, gambling plastic sheet and cash of Rs.500/were recovered from there.

The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and has falsely been implicated in this case due to some ulterior motive. He was not present at the spot and nothing relating to gambling was recovered from his possession.

On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria (R.S.) P.S. Case No. 926 of 2022, subject to condition as laid down under section 438(2) Cr. P.C.
