Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 20(b)(ii)(B), 22(b) and 29 of the N.D.P.S Act.

As per the prosecution case, on information, three miscreants boarded on a motorcycle were intercepted by the police. During the search 2.5 kg ganja kept in two packets in a black bag were recovered.

Learned counsel for the petitioner has submitted that

the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The said recovery was made from the possession of the co-accused Ankit Kumar who has already been granted bail by the Co-ordinate Bench vide order dated 21.10.2022 passed in Criminal Misc. No. 40827 of 2022. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 06.07.2022.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Buxar in connection with Itarhi, P.S. Case No. 102 of 2022.
