The petitioner is apprehending his arrest in a
case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition & Excise Act.
There is recovery of 4345 litres of Indian made Foreign Liquor from a truck standing in the field of the petitioner.
It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner and while demarcation of the alleged place of land, no khata, khesra number has been

mentioned and it has vaguely been stated that the land belongs to the petitioner.
Considering the fact that the alleged truck was found standing in the field of the petitioner from where 4345 litres of Indian made Foreign Liquor has been recovered, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
The prayer for grant of anticipatory bail to the petitioner stands rejected.
