6 27-07-2022 The petitioners seek modification of the order dated 04.03.2020 passed in Cr.Misc. No.8651 of 2020, whereby though they have been granted anticipatory bail, but could not surrender within the stipulated period and also pray for extension of time for surrender in connection with Mohammadpur P.S. Case No.177 of 2019 before the C.J.M., Gopalganj.

It is submitted by the petitioners’ counsel that four weeks’ time was granted for surrendering to avail the benefit of

anticipatory bail. National lock-down, however, occurred within the four weeks’ period. Therefore, the petitioners could not surrender within time.

This Court in this background had called for a report from the trial court as to whether any order under Sections 82 and 83 of the Cr.P.C. has been issued or not. As per report dated 15.07.2022, no such order has been passed.

In view thereof, this Court would grant the petitioners further four weeks’ time from today for surrendering in compliance of the order dated 04.03.2020 passed in Cr.Misc. No.8651 of 2020.

The order dated dated 04.03.2020 passed in Cr.Misc. No.8651 of 2020 shall stand modified to the above extent.
