The petitioners seek anticipatory bail in connection with Complaint Case C.A. No. 1813 of 2016, registered for offences punishable under Sections 406 and 420/34 of the Indian Penal Code.

Allegation as per F.I.R. against the petitioners is that they have taken Rs. 1,62,000/- as an advance regarding executed agreement for sale in respect of three kathas land in favour of the complainant but they did not execute the sale deed nor return the money.

Submission of the learned counsel for the petitioners is

that allegation against the petitioner No. 1 is only that he had taken money from the complainant and they have falsely been implicated in this case only due to land dispute and they have no criminal antecedents.

Heard learned A.P.P. as well as learned counsel for

the informant opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioners to surrender before the learned court below within six weeks from the receipt/production of the order of the Court from today with Bank draft of Rs.62,000/- in favour of the Opposite Party No.2 and that petitioners shall be released on provisional bail to the satisfaction of this Court below for a period of two months and within two months, they will pay the remaining amount, on which their bail bonds shall be confirmed, otherwise the learned Court below is free to pass any other order or orders, which may be deemed fit and proper.
