2 06-12-2019 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in Runisaidpur P. S. Case No. 122 of 2016 instituted for the offence under Section(s) 302 and 201/34 of the Indian Penal Code.

It is submitted by the petitioners’ counsel that petitioner Nos. 1 and 2 are Gotani and Nanad of the informant. The informant has alleged killing of her husband by her in-laws. Similar allegation has been made by mother-in-law against the informant alleging that she has done her son to death. Other than suspicion, there is nothing to connect the petitioners with the offence. The other co-accused of the instant case has already

been allowed the privilege of bail under order passed in Cr. Misc. Nos. 35126 of 2016.

Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the CJM Sitamarhi, in connection with Runisaidpur P. S. Case No. 122 of 2016 subject to the following conditions:-

(i) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.

(ii) That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail bond will be liable to be cancelled.
