This application is for grant of regular bail in connection with Complaint Case No.3383(C) of 2015for the offences under Sections 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act..

Allegation against the petitioner is of subjecting his wife O.P.lno.2 for demand of dowry and parents of the O.P.no.2 intervened and thereafter she was kept for some time and again she was assaulted and ousted from the house.

Submission of the learned counsel for the petitioner is that there is no allegation of demand of dowry and the whole allegation is false and concocted rather he has stated on oath that he is ready to keep her.

Heard learned A.P.P. and the learned counsel for the O.P.no.2 They have stated that she is ready to reside with the petitioner but the difficulty is that she is being assaulted by the petitioner. .

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below on 1.7.2019 and on that day O.P.no.2 shall also remain present and further an affidavit shall be filed by the petitioner that he will keep her well and take her from the court itself and will not subject her to torture, he will be released on provisional bail for a period of six weeks and during that period, the learned court below shall watch the conduct of both the parties by calling them in the court in the first week of each month and once being satisfied with the conduct of both the parties, especially the conduct of the petitioner, he will consider about confirmation of bail of the petitioner or pass any order or orders including cancelling the bail bond of the petitioner.

With the above direction, this application is disposed of.
