Heard learned counsel for the petitioner and learned
counsel for the State.
The petitioner, who is in custody, seeks bail in connection with Darauli P.S. Case No. 155 of 2016 (Trial No. 88 of 2017) registered for the offence punishable under Sections 20/22 of the N.D.P.S. Act.
Allegation against the petitioner is that 135 gram Charas was recovered from his possession.
It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. It has been further submitted that similarly placed coaccused persons, namely Ajay Kumar Nishad and Vivek Kumar Nishad have already been granted regular bail by the court

below vide Darauli P.S. Case No. 155 of 2016 and some coaccused persons namely, Satish Jaiswal and Achhelal Nishad @ Acchelal Nishad have already been granted bail by this Hon’ble Court vide order dated 25.04.2018 and 18.07.2018 passed in Cr. Misc. No. 10206 of 2018 and Cr. Misc. No. 39446 of 2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addtional Sessions Judge, Siwan, in connection with Darauli P.S. Case No. 155 of 2016 N.D.P.S. Trial No. 88 of 2017.
