2 12-06-2018 Heard learned Senior counsel representing the petitioners, learned counsel representing the State and learned counsel representing the informant.

The petitioners, in the present case, are seeking regular bail in connection with Digha P.S. Case No. 186 of 2018, registered for offences alleged under Sections 468, 406, 420, 120B, 34 of the Indian Penal Code and under Sections 66, 67 of I.T. Act.

Learned Senior counsel representing the petitioners submits that the F.I.R. itself discloses that the deposits in question were allegedly made in favour of the Institution namely Indra

It is submitted that so far as these petitioners are concerned, they were only working as employees in order to earn their livelihood and it is not the case of the informant that any money was deposited in the name of these petitioners. It is further submitted that considering these aspects of the matter the learned coordinate Bench of this Court has been pleased to grant regular bail to the co-accused Annu Kumari vide order dated 07.06.2018 passed Cr. Misc. No. 32633 of 2018.

On the other hand, learned APP representing the State as also learned counsel representing the informant have opposed the prayer for bail. It is vehemently submitted on behalf of the informant that these petitioners are in fact acting hands in gloves with the persons who are running the Institution from behind the curtain. Learned counsel for the informant has further submitted that even though these petitioners are ladies and are said to be employees of the Institution but have been actively involved in duping the customers by motivating them to purchase the machine and for that purpose to deposit 50% of the amount of machine.

Considering the facts and circumstances of the case wherein it is not in dispute that these petitioners are said to be the employees of the Institution and they have not received the

amount in their own name as also that the co-accused Annu Kumari has been granted privilege of regular bail by a coordinate Bench of this Court, let the petitioners, above named, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Patna in connection with Digha P.S. Case No. 186 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
