Heard learned counsel for the petitioner, State and learned counsel for the informant.

The prosecution story, in brief, is that the petitioner happens to be the husband of the complainant Priyanka Devi who has levelled allegations that the accused persons subjected her to physical and mental cruelties in different ways including abuses and physical assault for non-fulfillment of their demand of a motorcycle in dowry. They also tried to set her on fire and kept her ornaments etc.

It has been submitted on behalf of the petitioner that the

petitioner has falsely been implicated in the present case. Further it has been submitted that the petitioner had filed an application under Section 9 of the Hindu Marriage Act for restitution of conjugal rights but the complainant is not ready to reside with the petitioner. It has further been submitted that the petitioner is ready to deposit amount of Rs. 1500/- per month in the court below which shall be released in favour of the complainant.

On behalf of the State, it has been submitted that the petitioner is husband of the complainant and he is named in the F.I.R.

Considering the fact that the petitioner is ready to deposit amount of Rs. 1500/- per month in the court below which shall be released in favour of the complainant, let the above named, petitioner, be released on bail in the event of his arrest or surrender before the learned court below within a period of eight weeks from today in connection with Complaint Case No. 4078 of 2012 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
