3 20-05-2015 The petitioner is apprehending his arrest in connection with Hilsa P.S. Case No. 233 of 2014 for the offences instituted under Section 364/34 of the Indian Penal Code.

Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the petitioner accused Niranjan Singh and his mother taken away his immature son, Rajesh Kumar @ Gandhijee for the purpose of execution of some deeds and thereafter, they might have killed or disappeared his son.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. It has further been submitted on behalf of the petitioner that the

informant in the court below has admitted that the present case has been instituted due to mistake of fact.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the fact that the matter has already been settled between the parties, let the above named, petitioner, be released on bail in the event of his arrest or surrender before the learned court below within a period of eight weeks from today in connection with Hilsa P.S. Case No. 233 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Hilsa, Nalanda, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
