The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/324/307/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that co-accused Amit Kumar fired on the informant but it did not hit him but, subsequently, coaccused, Manish Kumar fired which caused injury on the back of the informant. It is alleged against the petitioner that he was a member of the unlawful assembly.
It is submitted by learned counsel for the petitioner that neither any overt-act is alleged against the petitioner nor he carries any criminal antecedent as stated in paragraphs 8 and 3 of the petition.
