The petitioner seeks bail in connection with Balrampur (Telta) P.S. Case No.85 of 2013 registered under Sections 341, 323, 324, 326, 504/34 and later on added Sections 354, 379 and 307 of the Indian Penal Code.

The allegation is that the petitioner alongwith five others started to abuse and scuffle with Javerun, the niece of the informant, Md. Masood. When the informant rushed at the place of occurrence, then the petitioner and others started scuffle with him. At that time, the petitioner gave a farsa blow causing injury on the head of the informant.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that there is no repetition of farsa blow on the head of the informant by the

petitioner. The petitioner is in custody since 23.1.2014.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Balrampur (Telta) P.S. Case No.85 of 2013.
