The allegation of informant is that on receiving information about lying her mother unconscious on the road, she went there and after regaining conscious, she told about carrying her at the house of Molton where she was assaulted by putting the cloth in her mouth by him and others. The petitioner also administered her something at that time.

Learned counsel appearing on behalf of the petitioner submits that no motive has been assigned in the first

information report about the occurrence. In course of investigation, charge-sheet has been submitted under section 306 of the I.P.C. and it has come that earlier the deceased also made attempt to commit suicide. Further, it is also submitted that petitioner has no criminal antecedent and is in custody since 13.12.2013. It is also submitted that co-accused Shahin Parween @ Shai has already been allowed anticipatory bail by a Bench of this Court vide Cr. Misc. No. 44375 of 2013 on 25.10.2013.

Under the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Katihar in connection with Katihar Town P.S. Case No. 248 of 2013.
