JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 27-01-2014 Petitioner is languishing in custody since 20.08.2013 in a case registered for the offences punishable under Sections 399, 402 of the I.P.C. and 25(1-b)A/26/35 of the Arms Act.
The prosecution case is that on information that accused persons are preparing to commit dacoity, raid was laid when from the possession of the petitioner one mobile was recovered, though arms were recovered from the co-accused.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Srikrishnapuri P.S. Case No. 331 of 2013.
