The petitioner was apprehended with ½ Kgs of ganja and 19 purias of smack. Submission is that there is no mention of weight of each puria of smack either in the seizure list or in the written report and without mentioning the weight the quantity cannot be ascertained. Further submission is that the petitioner is not involved in any other case of NDPS though he is accused in a case registered under Sections 461 and 379 of the Indian Penal Code as is mentioned in paragraph 3 of this application. The petitioner is in custody since 01.11.2013.
