| The petitioners are accused of a case registered against them and other two under Sections 302/34 of the Indian Penal Code. After investigation chargesheet has been submitted under Section 306 of the Indian Penal Code and cognizance has also been taken under that Section. |
Informant’s husband was heavily drunk. He was taken inside the house and was assaulted which led to his death. Submission is that the informant’s husband tried to outrage the modesty in the night and the informant herself has admitted that her husband has taken excessive liquor. The petitioners have not caused any assault to the informant’s husband.
Considering the facts and circumstances of the case,

the petitioner above named is directed to be released on furnishing of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Adhoc Additional Sessions Judge 3/concerned Court, Purnea in connection with Sadar (Mufassil) P.S. Case No. 403 of 2013.
