The petitioner is one of the named accused of the case which has been registered under Section 307 and some other Sections of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is of firing which has caused injury on the waste.

Submission is that there is case and counter case. The counter case is under Section 307 and some other Sections of the Indian Penal Code. There was no repletion. Present case is the first case in which the petitioner has been implicated. The injury was not on vital part of the body. The petitioner is having passed B.Sc. with Ist Division and is a student of M.Sc. and has been wrongly

framed.

Learned counsel appearing on behalf of the informant has opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate/court concerned, Saharsa in connection with Saharsa Sadar P.S. Case No. 603 of 2013.
