The petitioner seeks bail in a case which has been registered under Section 414 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of the Arms Act. After recovery of motorcycle the case was registered and the petitioner was suspected to be in possession of the stolen articles. Submission is that the recovery was not from conscious possession of the petitioner. He was not arrested on the spot but was arrested from the house subsequently on the confession of the co-accused.
