JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 10-04-2014 The present application has been filed for quashing the First Information Report of Lakhnaur P.S. Case No. 51 of 2012 registered for the offences under Section 381 of the Indian Penal Code pending in the court of learned ACJM, Jhanjharpur, DistrictMadhubani.
The prosecution case is that the petitioner was a guard in the Airtel mobile tower but he fled away with solar plate, battery, 100 litres diesel and 200 meter copper wire.
It is submitted by learned counsel for the petitioner that all articles were handed over to the other guard which has been found true by the I.O. during investigation.
This Court is not inclined to interfere at this stage of investigation.
Accordingly, this application is disposed of with
