JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 09-04-2014 The present application has been filed for quashing the order dated 11.12.2012 passed by learned SubDivisional Judicial Magistrate, Vaishali at Hajipur in Complaint Case No. 32 of 2012, whereby processes were directed to be issued after cognizance being taken for the offences punishable under Sections 304B, 120B of the I.P.C.

The petitioner is father-in-law of the victim. The accusation is of killing the sister of the informant after six years of marriage for non-fulfilment of dowry demand.

It is submitted by learned counsel for the petitioner that actually the marriage was performed more than eight years prior to the occurrence when there is no specific accusation against the petitioner and during investigation, it transpired that the victim died during treatment.

This Court is not inclined to interfere at this stage of proceeding.

Accordingly the application is disposed off with liberty to the petitioner to raise all the contentions at the time of framing of charge, if the charge has already not been framed in connection with Complaint Case No. 32 of 2012, Trial No. 2573 of 2014, pending in the Court of learned SubDivisional Judicial Magistrate, Vaishali at Hajipur.
