The petitioner seeks bail in Bidupur P.S. Case No. 118 of 2014, registered for the offences punishable under Sections 399, 402 of the Indian Penal Code read with Sections 25(1-b)A, 26 and 35 of the Arms Act.

It is submitted that the petitioner has falsely been implicated in the case. Although, no arms and ammunitions was recovered from the possession of the petitioner. Petitioner is an accused in Hajipur Sadar P.S. Case No. 429 of 2010, but he is on bail. There is no other criminal case pending against the petitioner.

Having considered the aforesaid facts that one country made pistol and one live cartridge were recovered from the possession of the petitioner and the petitioner is in custody for more than six months, the above named petitioner is
