The petitioner, Gaurav Kumar @ Gaurav Kumar Jha, seeks regular bail in Alamganj P.S. Case No.192 of 2013 under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b)A/26/35 of the Arms Act.

The informant, on information, raided near the Ganga Bridge and apprehended the petitioner and others. From the possession of the petitioner, one loaded country made pistol and one live cartridge were recovered.

Learned counsel for the petitioner submits that similarly situated co-accused, namely, Heera Choudhary, has already been enlarged on bail by this Court vide order dated 28.01.2014 passed in Cr. Misc. No.671 of 2014. Petitioner is in jail since 06.06.2013.

The learned Additional Public Prosecutor did not

Of course, there appears that the petitioner has got criminal antecedent, but the petitioner has remained in jail for about one and half years for recovery of one loaded country made pistol and live cartridge, his prayer for bail is allowed.

The petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna City in connection with Alamganj P.S. Case No.192 of 2013.
