4 03-12-2014 Heard both sides. The petitioner seeks bail in Chapra Town Thana P.S. Case No. 173 of 2014, registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Ram Babu Rai, the informant alleged that Upendra Rai, caught his younger brother Sanjit Rai and thereafter Baunty Rai fired which hit on the temple of Sanjit Rai. The informant further alleged that Manoj Rai, the petitioner also fired from in front of Sanjit Rai.

Learned counsel for the petitioner submits that there is only one injury found on the temple of the dead body of Sanjit Rai. From the post-mortem report it would appear that

there is one injury on left side of temple and there is no other injury and therefore the allegation against the petitioner appears to be false.

It appears that although the petitioner is alleged to have fired from the front of Sanjit Rai, but no corresponding injury was found on the body of Sanjit Rai. One injury, which is found on the left temple, is attributed to Baunty Rai.

Having considered the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town Thana P.S. Case No. 173 of 2014.
