The petitioner seeks regular bail in a case registered under Sections 7 of the Essential Commodities Act, 1935.

Allegedly during raid the petitioner was found selling fertilizer without any proper licence and accordingly as per seizure list fertilizer of different brand was seized.

Submission at the Bar for release of the petitioner is that he has been implicated due to dirty village politics. No offence as alleged is made out. The petitioner is a farmer having 3o acres of land and had purchased the said fertilizer for his own use. The alleged place of recovery is not a shop rather his residential house and the petitioner having no criminal antecedent is suffering in custody since 20.5.2014 to which the learned

In the facts and circumstances, as stated above, considering the detention of petitioner, now the petitioner Arjun Purvey is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Birpur, Supaul in connection with Pratapganj P.S. Case No.6 of 2014.
