The petitioner seeks pre-arrest bail in a case registered for the offences punishable under sections 420 of the Indian Penal Code and 138 of the N.I.Act

At the very outset, it has been submitted that the petitioner received a sum of Rs.3,50,000/- for personal work and not as alleged and, thereafter, the petitioner issued two cheques one of Rs.2,00,000/- and another of Rs.1,50,000/- but the same bounced as the account was closed. Thereafter, the petitioner gave Rs.1,00,000/- cash and a cheque of Rs.50,000/- which the complainant received under receipt and for rupees two lakh he is always ready to pay the same in installments.

jail, no useful purpose is going to be served. Learned A.P.P. appearing for the State fairly concedes that in case the petitioner pays the amount, a lenient view can be taken.

Considering the facts and circumstances of the case, as stated above, in case the petitioner deposits Rs.50,000/- by way of first installment within fifteen days from receipt of the order, in the event of arrest or surrender in the court below, the petitioner, namely, Shantu Sinha shall be released on bail temporarily on furnishing bail bond of Rs.10,000/(ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anwar Shamim, Judicial Magistrate/concerned court, Bhagalpur in Complaint Case No.1748 of 2012 and after payment of rest amount in equal three installments within next three months, the temporary bail granted shall stand automatically confirmed.
