JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 2 10-07-2014 Heard learned counsel for the petitioner and learned A.P.P. for the State. The petitioner seeks regular bail in a case registered under Sections 33, 41 and 42 of the Indian Forest Act, 1927.

Allegedly, 600 cubic feets stones loaded on a truck which was being driven by the petitioner no.1 and the petitioner no.2 being the Khalasi thereon was recovered near Fajilpur. Submission at the Bar for release of the petitioner is of false implication and that the said stone material were purchased from M/s Anjani Stone Chips for which valid Mining challan has been issued by its proprietor,Arun Kumar Singh, on 20/05/2014 for house construction of the owner of the truck to which learned A.P.P. opposes.

Considering the aforesaid submission and further

noticing the custody of the petitioner since 29/05/2014, the petitioners Satya Nand Singh @ Sachita and Munna Yadav, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram in Forest Case No. 29 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioners shall remain physically present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
