The petitioner seeks regular bail in a case registered under Sections 147,148,149,379, 120B and 427 of the Indian Penal Code, Section ¾ of the Explosive Substance Act and Section 17 of the Criminal Law Amendment Act.

Allegedly building of a Primary School was exploded by the miscreants and the petitioner is also named in the FIR. Submission at the Bar for release of the petitioner is that in this case other named co accused- Suraj Mahto @ Gope Jee and Madhurendra Kumar @ Tuntun @ Dara Mahto have already been allowed by the court below itself but the prayer of the

petitioner has been rejected only on the ground that the petitioner was absconding since 2010.

Learned A.P.P. is not in a position to distinguish the case of the petitioner from those accused persons but submits that the petitioner remained absconding.

Considering the facts and circumstances, as stated above, and the period of detention of the petitioner, he (Ranjeet Paswan) is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Danapur, Patna, in Paliganj P.S.Case No. 90/2010,subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain physically present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
