The petitioner seeks regular bail in a case registered under Sections 392 and 412 of the Indian Penal Code.

Allegedly, Bolero Maxima vehicle bearing registration no. BR-03G-5712 ,white colour, was snatched away at the point of pistol after throwing the driver and during investigation the name of the petitioner has transpired on the basis of confessional statement of co accused Vikash Rai and thereafter the said vehicle was recovered from one Leader Automobile Service Center, Patna-Gaya road.

Submission is that the petitioner has not been put on T.I. parade, nothing has been recovered from his conscious possession. The police came to the conclusion that the petitioner has no hand in commission of offence and he is suffering in custody since 07/04/2014.

alleged, and as submitted, there is no recovery from the conscious possession of the petitioner and as such the petitioner, Mukti Narayan Rai, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Arrah in Bihia P.S.Case No. 22/14,subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
