Case No. 2 of 2014 registered for the offences punishable under Sections 498A, 307, 504 of the Indian Penal Code and Section 31 of the Domestic Violence Act. Allegedly, the petitioner being the husband of the informant after taking wine abused her, assaulted with fist and slaps and after sprinkling kerosene oil on her face burnt her badly. Submission at the bar for release of the petitioner is that the occurrence is of 24.12.2013 whereas the FIR has been lodged on 2.1.2014 after instigation by the father. As a matter of

fact, the informant and the petitioner received injuries in accidental burn on 21.12.2013 itself and both were treated in Sunita Nursing Home vide annexures-2 and 3 series.

In the facts and circumstances as stated above, noticing the prescriptions of Sunita Nursing Home wherein Kamli Devi was treated on 21.12.2013 for accidental burn over face and further the petitioner has also received burn injury, though simple in nature, as such the petitioner Vikram Urown is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Adhoc Additional Sessions Judge-8, Purnea in S. T. No. 403 of 2014 arising out of Mahila P.S. Case No. 2 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
