2 18-06-2014 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in a case registered under Sections 20,22,23,24,27(A) and 29 of the Narcotic Drugs and Psychotropic Substance Act.

Allegedly acting on an information, a team of the police raided the place and caught 13 miscreants and on search some ornaments, mobile ,fire arms and other articles were recovered from their conscious possession, as detailed in the seizure list and further from that place one bag containing 5 Kgs of Charas was also recovered.

that the alleged Charas have not been recovered from the conscious possession of these petitioners and similarly situated co accused Mithun Paswan, Sobhan Paswan and Raju Paswan have already been allowed bail by another bench of this Court vide Cr. Misc. No. 44917/2013 by order dated 22.4.2014.

In the facts and circumstances, as stated above, let petitioners, Ramesh Paswan, Dharamveer Paswan @ Dharamveer Kari @ Paswan, Ravindra Paswan @ Ravidnra Kr. Paswan and Sanjay Paswan, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bettiah,West Champaran in Shikarpur P.S.Case No. 354 of 2012,subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
