9 22-04-2014 Heard Mr. Anis Akhtar, learned counsel for the
petitioners and Smt. Anuradha Kumari, learned Addl. Public
Prosecutor.
Two petitioners, invoking inherent jurisdiction of this
Court under Section 482 of the Code of Criminal Procedure, have
prayed for quashing of an order 01.04.2009 passed by the learned
Judicial Magistrate, 1 st Class, Dalsinghsarai, Samastipur in G.O.
Case No.02/2001, Trial No.417 of 2011. By the said order, the
learned Magistrate has taken cognizance of offence under Sections
33, 41 and 42 of the Indian Forest Act, 1927 and Section 9 of the
Bihar Amendment Act, 1990.
Learned counsel for the petitioners submits that the order
of cognizance is liable to be set aside on the ground that without
any formal complaint or prosecution report, the learned Magistrate
