Submission at the bar for release of the petitioner is that there is no specific allegation against the petitioner, co-accused Rajniti Mandal, Neeraj Yadav and Ranjan Yaav were put on trial and they have been acquitted by F.T.C.V, Munger on 3.11.2010 in Sessions Trial No.629 of 2005 due to lack of evidence and further most of the accused persons have been granted bail by different orders of this Court and recently Futun Yadav @ Futan Yadav vide Cr. Misc. No.4026 of 2014 to which the

learned A.P.P. is not in a position to distinguish the case of the petitioner from those accused.
In the facts and circumstances as stated above, the petitioner Ajeet Yadav is hereby directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Adhoc Additional District and Sessions Judge-VIIIth, Munger in Naya Ram Nagar P.S. Case No.176 of 2004 dated 19.11.2004 in S.T. No.45 of 2014.
