On getting confidential information that petitioner is about to unload spurious wine from a pickup van having been parked in a concealed manner, a raid was conducted and on search of said van different items as per seizure list were recovered.

It has been submitted on behalf of the petitioner that from narration of the self statement of informant, it is apparent that he happens to be hostile to the petitioner since before. It has further been submitted that petitioner was not at all present at the spot nor his house stands nearby but the informant on his own incorporated the fact that one person managed to escape who was identified as petitioner. custody since 15.04.2014.

On the other hand, learned APP opposed the prayer for bail and submitted that petitioner has got criminal antecedent on account of being indulged in similar kind of activities.

Taking into account allegation on its face inconsonance with period of custody, petitioner, Dhrub Singh @ Dhrup Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Shri Brijesh Kumar, Judicial Magistrate, 1^st Class, Chapra, Distt- Saran in connection with Baniyapur P.S. Case No. 53 of 2014.

However, it is made clear that subsequent involvement of petitioner in similar kind of offence will deprive him of enjoying the privilege.
