While the informant/ victim Bhikhari Sahni gone to pacify the quarrel having amongst the children, it has been alleged that petitioner along with five others brutally assaulted with iron rod resulting fracture of rib. They also took away Rs.30,000/- from his house which informant had received in lieu of Indira Awas Yojna.

It has been submitted on behalf of petitioner that virtually the prosecution party were aggressors and on account thereof, petitioner had instituted Minapur P. S. Case no.255 of 2013 and after coming to know about the institution of the aforesaid case, then and then only informant got this case registered. Further submitted that even from perusal of the fard-

bayan, it is evident that there happens to be omnibus allegation against six persons with regard to assault as well as taking away Rs.30,000/-. Also submitted that petitioner happens to be under custody since 31.03.2014.

Contrary to it, learned Additional Public Prosecutor opposed the prayer and submitted that from the order impugned, it is apparent that informant was severely assaulted, but fairly concedes with regard to nature of allegation.

Consequent thereupon, petitioner Sakhichandra Sahni @ Sakhindra Sahni is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P. S. Case No.297 of 2013.
