Informant an adolescent aged about 15 years along with her friend Kavita Kumari was sleeping at latter’s house in between 12/13.02.2014, petitioner, after removing thatched wall trespassed and un-tied string and then unsuccessfully attempted to rape. However, was apprehended and on the following morning was produced before the police along with written report submitted by informant.
From the case diary, it is apparent that after concluding investigation, chargesheet has been submitted under Section 354(A) of the I.P.C. and for that petitioner happens to be under custody since 13.02.2014. It has also been pleaded that petitioner has got no criminal antecedent.

On the other hand, learned Additional Public
Prosecutor opposes the prayer.
On account thereof, petitioner Kamo Yadav @ Kamlesh Yadav is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria Muffasil P. S. Case No.84 of 2014.
