The petitioner is facing accusation(s) punishable under section 3 of R.P. (U.P.) Act in connection with R.P.F. Jhajha Post Case No.6 of 2013.

The Inspector of police (Railway) lodged the FIR alleging therein that 121 bags of D.A.P. were unloaded and kept on the railway platform. Accused persons committed theft thereof. One of the accuseds was offered chase and arrested who is said to have disclosed names of several persons including the petitioner.

The contention of the petitioner is that except the confessional statement of the co accused Md. Ansar there is no other material directly incriminating the petitioner with the commission of offence. The petitioner has no criminal antecedents. There is no recovery from the petitioner. One of the accuseds having identical/similar allegation has since been released on anticipatory bail, a copy whereof has been enclosed at Annexure 2/A.

Considering the facts and circumstances of the case, in the event of arrest/surrender within three weeks from today, the petitioner above named shall be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Kiul in connection with R.P.F. Post Jhajha Case No. 6 of 2013 subject to the condition that one of the bailors shall be own/close relative of the petitioner. Upon filing of charge sheet and framing of charge(s) the petitioner shall continue to appear in person before the court below on all dates. In the event of default in doing so on two consecutive dates the court in seisin of the matter shall cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
