Allegedly, the minor daughter of the informant was kidnapped by the petitioner and other co-accused with an intention to marry the petitioner with her and during investigation the victim in her statement recorded under Section 164 Cr.P.C. has stated about her kidnapping by the petitioner and others but has stated that no sexual assault was committed upon her by the petitioner and the petitioner brought her at Sirasia Police Station.

that the victim girl is not minor, as per medical report she is just below 19 years, as admitted by the victim no sexual assault was committed upon her and it was simply a case of love affairs, the petitioner who is suffering in custody since 15.06.2013 deserves sympathetic consideration to which the learned Additional Public Prosecutor opposes.

In view of the facts as stated above and noticing that the petitioner has not committed any sexual assault upon the victim, the petitioner, Krishna Ram is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Bagaha (Pathkauli) P.S. Case No. 303 of 2011 with conditions that one of the bailors must be near relative and the other having sufficient immovable property within the jurisdiction of the trial court and further the petitioner shall remain present during the trial on each and every date and two consecutive defaults without any reasonable cause shall disentitle him from the privilege of bail.
