The petitioner prays for grant of bail in connection with Khudawan P.S. Case No. 35 of 2013 registered for the offence under Sections 147, 148, 149, 341, 323, 325, 307, 379, 427, 435 of the Indian Penal Code and 17 of C.L.A. Act.
Submission at the bar for release of the petitioner is that during investigation the name of petitioner transpired and the petitioner also made confession before the police, besides that nothing has been recovered from possession of the petitioner, he has not been put on Test Identification Parade and is suffering in custody since 24.09.2013, in identical case, the petitioner has been allowed bail by another Bench of this Court vide Cr. Misc. No. 5797 of 2014 vide Annexure-2 to which the learned Additional Public Prosecutor does not dispute.

In the facts and circumstances as stated above, the petitioner, Umesh Yadav is hereby directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daud Nagar, Aurangabad in connection with Khudawan P.S. Case No. 35 of 2013 with conditions that one of the bailors must be near relative and the other having sufficient immovable property within the jurisdiction of the trial court and further the petitioner shall remain present during the trial on each and every date and two consecutive defaults without any reasonable cause shall disentitle him from the privilege of bail.
