The petitioners apprehend their arrest for the offences alleged under Sections 147, 341, 323, 504 of the Indian Penal Code and Sections 3(I) (X) of the SC/ST Act registered in connection with Gwalpara P.S. Case No. 88 of 2013.

It is submitted that even on the averments on the fardbeyan of the informant, the ingredients of offences under SC/ST Act are not made out, as the informant has not been abused with reference to his caste or in public view.

circumstances of the case, as such, in the event of the petitioners’ arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Gwalpara P.S. Case No. 88 of 2013, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
