The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

It is contended that the case was registered against unknown. In course of investigation, one Sheo Sagar Choudhary was arrested on suspicion and on the basis of his confessional statement, the petitioner has also been made accused in the present case

It has further been contended that no incriminating article has been recovered from the possession of the petitioner and till date the petitioner has not been put on T.I. Parade.

The co-accused, Sheo Sagar Choudhary, on whose confessional statement the petitioner has been implicated in the present case, has already been granted bail vide order dated

16.5.2013 passed in Cr. Misc. No.21632 of 2013 by another Bench of this Court.

Considering the facts and circumstances of the case, the petitioner who is in custody since 2.12.2013 is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Buxar (Industrial) P.S. Case No.38/2013.
