Having regard to the nature of allegation against the petitioner for offence under section 409/34 of the Indian Penal Code while this Court was impressed with the submission of the learned counsel for the petitioner that in the subsequent auditor’s report no embezzlement of fund was found but the conduct of the petitioner, unfortunately a teacher of Veer Kunwar Singh University, in filing a surrender cum bail petition and thereafter running away from the court by making allegation against the court and seeking a transfer of a case from that very court would automatically disentitle him from being given privilege of anticipatory bail. Thus, the petitioner must surrender and seek regular bail wherein his plea of audit report will also be examined

report is of a private Chartered Accountant.
