Having regard to the nature of allegation against the petitioner for offence under sections 366A/380 of the Indian Penal Code and the fact that the kidnapped girl in her statement under section 164 Cr.P.C. has stated that she had married Sanjeev Kumar (petitioner) on her own accord and in fact she was never kidnapped by anyone, this Court would find that the petitioner, who otherwise has got no criminal antecedent, has made out a case for grant of anticipatory bail.

That being so, if the petitioner Sanjeev Kumar @ Sanjiv Kumar, surrenders before the court below within a period of four weeks from today he shall be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial

Magistrate, Danapur, District Patna in Danapur P.S.Case No. 161/2013, subject to the following conditions:

(i) The two bail bonds will be furnished by his close family relatives.

(ii) The petitioner will remain present in course of trial on each and every day and his absence even for two consecutive dates would automatically entail the consequences of cancellation of his bail.

(iii) The petitioner in case is now made accused in any other criminal case, that would itself lead to cancellation of his bail.
